    FACTS
* 20 seconds to start, Astral and Le Billet on starboard, overlapped with Le Billet to windward.
* Astral hailed Le Billet to keep clear, which Le Billet did, but restricted Astral from sailing close hauled.
* Le Billet infringed Astral and subsequently completed a 720o turn
* Wings came from clear astern of Astral, travelling faster and significant contact was made between the bow of Wings and the starboard stern section of Astral causing serious damage.
* Wings subsequently completed a 720 turn.

CONCLUSIONS
* Le Billet breached rule 11 and subsequently exonerated. No contact occurred. No further penalty required.
* Wings breached rule 12, causing serious damage. Wings completed a 720 turn, however under rule 44.1 (b) Wings is disqualified.

5 Antares [AUS29] Scoot [7108] 4   on

    FACTS
1. At 30 seconds prior to the start Antares & Scoot were on starboard tack and overlapped.
2. Antares was on the starboard tack layline to the boat end of the starting line.
3. Scoot to windward of Antares and travelling faster sailed into the space between Antares and the committee boat.
4. Antares, the leeward boat had to alter course to allow room for Scoot to pass between Anatres and the committee boat.

CONCLUSIONS
1. Scoot as windward boat was required to keep clear and failed to do so.
2. Scoot did not exonerate herself.

4 Stealth [7158] Under the Influence [AUS209] 2   on

    FACTS
Stealth took between 2 - 3 minutes after the incident to display a red flag.

CONCLUSIONS
RRS 62.1 (a) The protest by Stealth is invalid and the hearing is closed.
3 Allegro [6263]   2   on
30/01/2019
    FACTS
1.Allegro was sailing to windward from Mackerel Beach in 20 28 knots of wind.
2.Allegro observed a person in the water to leeward and in the vicinity of Portuguese Beach.
3.Allegro stopped racing and called for assistance.
4.Mosquito answered Allegros call and rescued the person.
5.No medical assistance was required.
6.Allegro retired from the race.

CONCLUSIONS
RRS 62.1 (c) and Appendix A10. Allegros request for redress is granted and she is awarded points equal to the average, to the nearest tenth of a point (0.05 to be rounded upward) of her points in all the races in the series except the race in question.
2 2107 Racing [1213] Starlight [6453] 5   1800 on

    FACTS
1.Windspeed is 12 to 15 knots. Flat water.
2.2107 Racing did not display the required racing pennant nor the division flag.
3.2107 Racing tacked onto port no more than 10 boatlengths from the Stokes point mark that was required to be rounded to starboard.
4.On the completion of the tack, 2107 Racing was approximately 1 boatlength clear ahead of Starlight. Both boats were close hauled with Starlight approximately 1 boatlength over the layline and 2107 Racing approximately 1.5 boat lengths above the layline to the mark.
5.Starlight s speed was slightly faster that 2107 Racings speed.
6.At 4 boat lengths from the mark, 2107 Racing was clear ahead of Starlight by 2 to 3 feet.
7.Starlight became inside overlapped boat when 2107 Racing bore away to sail to round the mark.
8.2107 Racing curtailed her turn around the mark, while still overlapped with the mark, as Starlight was on a course that would have resulted in contact between Starlights bow and the starboard side of 2107 Racing at approximately 2 meters from the stern.
9.Starlight touched the mark while rounding it and took a 1 turn penalty.

CONCLUSIONS
1.The representative of Starlight and the witnesses from Starlight presented evidence in a way to indicate they treated this incident as a racing incident. For example, they talked about the mark zone, being clear astern and then gaining an overlap as well as the different mark rounding rules. This satisfied the Protest Committee that Starlight was applying the rules of Part 2 during the incident.
2.There is reasonable doubt that Starlight had obtained an inside overlap before 2107 Racing reached the zone. Therefore, under 18.2(e) it shall be presumed that Starlight did not establish the overlap in time.
3.2107 Racing curtailed her rounding when she believed there would be contact and therefore Starlight did not give 2107 Racing room to round the mark under rule 18.2(b) and 18.2(c)(2).
4.NoR/SI 18.1 requires a 2 turn penalty for a breach of a part 2 rule that occurs within the zone of a mark. Starlight, by taking a 1 turn penalty did not take an alternative penalty for the rules breach.

Starlight is disqualified from Race 5 - Pittwater Inshore Series
1 Edake [007] Outlaw [AUS040] 1 1615 on

    FACTS
1.Double Black was overlapped ahead and inside of Edake as both yachts approached the leeward gate mark on
the Port gybe at a speed of approximately 7 knots in a South East Wind of approximately 15 knots.
2.Outlaw was approaching the same gate mark on the Starbord gybe at a speed of approximately 8 knots with
Edake 4 boat lengths ahead on Outlaw's course.
3.Double Black crossed clear ahead of Outlaw and rounded the gate mark.
4.As Outlaw approached the zone they hailed Edake that they were overlapped
5.Edake responded that no overlap existed.
6.Edake continued on and then veered to Starbord of Double Black to give themselves room to get inside and
astern of Double Black for the upwind rounding.
7.Outlaw continued on then gybed on to Port gybe for the rounding of the mark, ending up between Edake and
the mark.
8.Edake came up to close hauled to round the mark , then bore away to avoid contact with Outlaw.
9.No Contact occurred

CONCLUSIONS
1.There is reasonable doubt that Outlaw had obtained an overlap on Edake at the time Edake entered the 3 boat
length zone around the gate mark therefore under 18.2(e) it shall be presumed that she did not.
